VoyZee End User License Agreement (EULA)

This End User License Agreement (the "Agreement") is a legal agreement between you and Universe Voy, Lda, a Portuguese company with tax number (NIF) 519712340 and registered office at Rua Castilho 14C 5ºandar, 1250-069 Lisboa, Portugal ("Universe Voy", "we", "us"). It governs your use of the VoyZee Travel mobile app (the "App") and the related services, including the website voyzee-travel.com (together, the "Services").

By downloading, installing or using the App, or by creating an account, you accept this Agreement. If you do not accept it, do not use the Services.

Age. You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you confirm that a parent or legal guardian has read and accepted this Agreement on your behalf.

How we handle your personal data is explained in our Privacy Policy, which forms part of this Agreement.

Important: VoyZee has zero tolerance for objectionable content and abusive users (section 4). Violating these rules leads to removal of content and may lead to suspension or termination of your account.

1. License

1.1 Grant. Subject to this Agreement, Universe Voy grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and use the App on devices that you own or control, for your own personal, non-commercial purposes. If you downloaded the App from the Apple App Store or Google Play, this license is also subject to that store's usage rules (section 10).

1.2 Restrictions. You may not, and may not allow anyone else to:

  • copy, modify, translate or create derivative works of the App, except as the law expressly allows;
  • decompile, reverse engineer or disassemble the App, or try to extract its source code, except to the extent applicable law permits this despite this restriction;
  • rent, lease, lend, sell, sublicense, distribute or otherwise make the App available to third parties;
  • remove, hide or change any copyright, trademark or other proprietary notices;
  • bypass, disable or interfere with security features, usage limits or Premium restrictions;
  • access the Services through automated means (bots, scrapers, crawlers) or overload or disrupt them;
  • use the Services for any unlawful, fraudulent or harmful purpose, or in breach of this Agreement.

1.3 Ownership. The App is licensed, not sold. Universe Voy and its licensors keep all rights, title and interest in the App and the Services, including all intellectual property rights. Any right not expressly granted to you is reserved.

1.4 Updates. We may release updates that add, change or remove features. Some updates may be required to keep using the Services. We provide updates and keep the App in conformity as required by applicable consumer law.

2. Accounts, guest use and offline use

2.1 Guest use. You can use many features without an account. Data you create as a guest is stored only on your device, and we cannot recover it if the device is lost, reset or the App is uninstalled.

2.2 Your account. To sync your data, share trips and use some features, you need an account. You agree to give accurate information, keep your login details confidential, and tell us promptly at voyzee.travel@gmail.com if you suspect unauthorised use. You are responsible for activity under your account, unless it results from our fault. Accounts are personal and may not be sold or transferred.

2.3 Offline use. The App stores a copy of your data on your device so many features work offline. Some features need an internet connection, including signing in, sharing trips, invitations, editing your profile, adding or changing passport stamps and pages, finding nearby places, claiming verified stamps, and buying subscriptions. Changes made offline are synchronised when you reconnect. If the same data was changed on several devices, the App may ask you which version to keep.

2.4 Backups. We take reasonable care to keep your data safe, but we recommend keeping your own copies of photos and information that matter to you.

3. Your content

3.1 Ownership. You keep all rights to the content you add to the Services, such as trips, notes, photos, stamps and your profile ("Your Content").

3.2 License to us. You grant Universe Voy a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example resize or compress images), display and transmit Your Content, only to operate, provide and improve the Services for you, including showing shared content to the users you choose. This license ends when you delete Your Content or your account, except for copies kept in backups for a limited time, content other users already received, or where the law requires us to keep it.

3.3 Your responsibility. You confirm that you have all rights needed to upload Your Content, and that it does not infringe anyone's rights. If Your Content shows or names other people, you confirm you have their permission. We do not review content before it is posted, but we may remove content that breaks this Agreement or the law.

4. Community rules: zero tolerance

VoyZee lets you share trips and content with other people. There is no tolerance for objectionable content or abusive users. You must not upload, share or send content, or behave in a way, that:

  • is illegal, or promotes illegal activity;
  • harasses, bullies, threatens, intimidates or stalks anyone;
  • is hateful or discriminatory, including on the basis of race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation or age;
  • is sexually explicit or pornographic, or sexualises minors in any way;
  • depicts or encourages violence, self-harm, terrorism or cruelty;
  • is defamatory, deceptive, fraudulent or impersonates another person;
  • infringes someone's intellectual property, privacy or image rights, including sharing personal information about others without permission;
  • is spam, advertising or unsolicited commercial content;
  • contains viruses or harmful code, or tries to gain unauthorised access to the Services or other users' data.

Reporting and blocking. You can report content or users and block other users in the App, or email voyzee.travel@gmail.com. Blocking a user stops them from interacting with you.

What we do. We review reports and act on objectionable content within 24 hours. We may remove content, restrict features, and suspend or permanently terminate the accounts of users who break these rules, and we may report illegal content to the competent authorities. Where the law requires it, we tell you the reasons for our decision and how to contest it.

5. Premium subscriptions

5.1 What Premium includes. VoyZee Premium unlocks extra features, which are described in the App before you buy. The free version has limits (for example on the number of trips and passport stamps). We may improve or change Premium features, but we will not substantially reduce what you paid for during a paid period without your agreement, unless the law allows it.

5.2 Plans and prices. Premium is offered as monthly or annual auto-renewing subscriptions. Prices, billing period and any applicable taxes are shown before you confirm a purchase and may vary by country.

5.3 In-app purchases (App Store and Google Play).

  • Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
  • Your subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
  • You manage and cancel your subscription in your Apple or Google account settings. Deleting the App or your VoyZee account does not cancel it.
  • Refunds for in-app purchases are handled by Apple or Google under their policies; we cannot issue them directly.
  • If a free trial is offered, any unused part of it ends when you buy a subscription.

5.4 Website purchases. Subscriptions bought on voyzee-travel.com are processed by Stripe, renew automatically until cancelled, and are managed or cancelled on the Website. To use them in the App, you link them to your account with the code you receive.

5.5 Price changes. If we change the price of a subscription, we will tell you in advance, and the new price applies only from your next renewal. Where your store or the law requires it, we will ask for your consent; if you do not agree, you can cancel before the change takes effect.

5.6 Right of withdrawal (EU and UK consumers). If you are a consumer in the EU or UK, you may have a right to withdraw from a purchase within 14 days, under Portuguese Decree-Law 24/2014 and equivalent laws. Premium starts immediately after purchase at your request; if you withdraw within the 14 days, you may have to pay for the part of the period already provided, to the extent the law allows. For App Store and Google Play purchases, request this through Apple or Google; for Website purchases, contact us.

5.7 One account per subscription. A subscription can be linked to only one VoyZee account:

  • If you buy Premium without an account, it is saved on your device. When you sign in or create an account, it is linked to that account permanently; we tell you before and after this happens.
  • A subscription already linked to an account cannot be moved to another account, and restoring it from a different account will not work.
  • If you sign out, Premium linked to your account is no longer available on that device until you sign in again.
  • If you link a device subscription to an account that already has Premium, you will hold two subscriptions. The App warns you first and explains how to cancel one.

6. Places, travel information and your safety

6.1 Information only. Country, city and attraction information, maps, distances, budgets and other content in the App are provided for general information and planning. They may be incomplete, out of date or inaccurate. Always check important details (opening hours, prices, entry rules, visas, health and safety advice) with official sources before you travel. Universe Voy is not a travel agent or tour operator and does not sell or organise travel services.

6.2 Verified places and stamps. Some features let you claim stamps at real-world places using your location or NFC tags. To claim, you must actually be at the place; trying to fake your location or tamper with tags is a breach of this Agreement. Places may be added, changed or removed at any time.

6.3 Stay safe. You are responsible for your own safety and conduct when visiting places. Do not use the App while driving or in a way that distracts you from your surroundings. Respect local laws, private property, opening hours and the rules of each place. Universe Voy does not invite you onto any property and is not responsible for your visits.

6.4 Shared expenses. Budget and expense-splitting tools are for convenience only. Settling payments between participants is your responsibility.

7. Intellectual property, third-party services and privacy

7.1 Our rights. "VoyZee", "Universe Voy", our logos, designs, illustrations, stamps, badges, maps, texts and other materials in the Services belong to Universe Voy or its licensors and are protected by intellectual property laws. You may not use them without our written permission, except as needed to use the Services normally.

7.2 Feedback. If you send us ideas or suggestions, we may use them freely and without obligation to you.

7.3 Third-party services. The Services work with third-party services, such as Apple and Google (sign-in, app stores, maps, notifications), Stripe and RevenueCat (payments and subscriptions), and Supabase (hosting). Your use of those services is also subject to their own terms. Links to external websites are provided for convenience, and we are not responsible for their content.

7.4 Privacy. Our Privacy Policy explains how we collect and use personal data.

8. Warranties and liability

8.1 Your legal rights come first. Nothing in this Agreement limits the rights you have as a consumer under mandatory law, including the legal guarantee that digital content and services conform to the contract (Portuguese Decree-Law 84/2021), or excludes liability that cannot be excluded by law.

8.2 Availability. We work to keep the Services available, secure and free of errors, but we do not guarantee that they will always be uninterrupted or error-free, or that every feature will be available in every country, on every device or offline. We may carry out maintenance, which may temporarily interrupt the Services.

8.3 Limits on our liability. To the extent permitted by applicable law:

  • we are not liable for indirect or unforeseeable losses, loss of profits or business opportunities, or losses caused by events outside our reasonable control;
  • we are not liable for losses caused by your breach of this Agreement, by third-party services, by content of other users, or by information you relied on without checking it (section 6);
  • for any other liability arising from slight negligence, our total liability to you is limited to the greater of the amount you paid us in the 12 months before the event or EUR 50.

These limits do not apply to liability for wilful misconduct or gross negligence, for death or personal injury caused by our negligence, for fraud, or to any other liability that cannot be limited under Portuguese or other mandatory law (including Decree-Law 446/85 on general contract terms).

8.4 Your responsibility. To the extent permitted by law, you will compensate Universe Voy for losses and reasonable costs resulting from claims by third parties caused by your breach of this Agreement or by Your Content.

9. Termination and changes

9.1 By you. You can stop using the Services at any time and ask us to delete your account from the App (Profile) or by email. Remember to cancel any active subscription in your store account or on the Website.

9.2 By us. We may suspend or terminate your access, with notice where reasonable, if you seriously or repeatedly break this Agreement, break the law, put other users or the Services at risk, or if we are required to by law. If we terminate without a valid reason, we will refund the unused part of any subscription paid directly to us. We may also stop offering the Services altogether with at least 30 days' notice, and refund any prepaid unused period.

9.3 What happens next. When this Agreement ends, your license ends and you must stop using the App. Sections that by their nature should continue (including 3.2 for the limited time stated, 7, 8 and 11) survive. Your data is handled as described in the Privacy Policy.

9.4 Changes to this Agreement. We may update this Agreement to reflect changes to the Services or the law. We will tell you about significant changes in the App or by email at least 30 days before they take effect, unless a change is required sooner by law or for security. If you do not agree, you can stop using the Services and cancel your subscription before the change takes effect; continuing to use them after that means you accept the new version.

10. Apple App Store and Google Play

10.1 Apple. If you downloaded the App from the Apple App Store, you and Universe Voy also agree that:

  • Parties. This Agreement is between you and Universe Voy only, not Apple Inc. ("Apple"). Universe Voy, not Apple, is solely responsible for the App and its content.
  • Scope of license. Your license is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
  • Maintenance and support. Universe Voy is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support.
  • Warranty. Universe Voy is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Product claims. Universe Voy, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • Intellectual property. If a third party claims that the App or your possession and use of it infringes their intellectual property rights, Universe Voy, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints or claims about the App should be sent to Universe Voy, Lda, Rua Castilho 14C 5ºandar, 1250-069 Lisboa, Portugal, voyzee.travel@gmail.com.
  • Third-party terms. You must comply with applicable third-party terms (for example, your mobile data provider's) when using the App.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this Agreement, and when you accept it, Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

10.2 Google Play. If you downloaded the App from Google Play, the Google Play Terms of Service also apply. This Agreement is between you and Universe Voy only; Google is not responsible for the App or its content.

11. Governing law, disputes and general terms

11.1 Governing law. This Agreement is governed by Portuguese law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

11.2 Courts. The courts of Portugal have jurisdiction over any dispute arising from this Agreement. If you are a consumer, you may also bring proceedings before the courts of the country where you live, and we may only bring proceedings against you there.

11.3 Out-of-court resolution. Before going to court, please contact us so we can try to resolve the issue. Consumers in Portugal may also use an alternative dispute resolution entity; the list is available at www.consumidor.gov.pt. You can also make a complaint in Portugal's electronic Complaints Book (Livro de Reclamações Eletrónico) at www.livroreclamacoes.pt.

11.4 General.

  • Entire agreement. This Agreement, together with the Privacy Policy, is the entire agreement between you and Universe Voy about the Services.
  • Severability. If any part of this Agreement is found invalid or unenforceable, the rest remains in effect, and the invalid part is replaced by a valid provision as close as possible to its purpose.
  • No waiver. If we do not enforce a right immediately, we have not given it up.
  • Assignment. You may not transfer your rights under this Agreement. We may transfer ours to a company that takes over the Services, provided your rights are not reduced.
  • Language. If this Agreement is translated, the English version prevails in case of any difference, unless the law requires otherwise.
